Terms of service
1. Provider
Chatinit (https://chatinit.com) is provided by [LEGAL_COMPANY_NAME], [LEGAL_ADDRESS], tax ID [LEGAL_TAX_ID], e-mail [LEGAL_EMAIL] (“we”).
2. The service
Chatinit is an AI chat widget that a customer adds to their website. It answers the website’s visitors using the documents the customer uploads, and shows the customer which questions it could not answer. The service is intended for businesses (“Customer”).
Answers are generated automatically by a language model. They are designed to rely only on the Customer’s documents, but may still be incomplete or wrong. The Customer is responsible for the content of their documents and for checking that the assistant’s answers suit their business.
3. Technical requirements
A current web browser with JavaScript enabled, an e-mail address, and — to embed the widget — a website where you can add a script tag.
4. Account
The agreement is concluded when you create an account. Provide accurate data and keep your password and your private API key secret; you are responsible for activity under your account.
5. Price and payment
The subscription costs $49/mo (USD) or 199 zł miesięcznie (PLN), depending on the currency offered at checkout. Taxes are added where applicable. Payments are processed by Stripe and renew monthly until cancelled. You can cancel at any time in the billing portal; the subscription then runs until the end of the paid period. Fees for a started period are not refunded unless the law requires it. The widget answers only while the subscription is active.
6. Acceptable use
- No unlawful content, and no content that infringes the rights of others.
- Do not upload special categories of personal data (Art. 9 GDPR) or data you have no right to process.
- Do not attempt to break, overload or bypass the service’s security or limits, or to access other customers’ data.
- Use the widget only on websites you control and have registered in the dashboard.
We may suspend an account that seriously breaches these rules, after a warning where possible.
7. Your content
You keep all rights to your documents and settings. You allow us to store and process them only as needed to provide the service to you.
8. Availability and changes
We aim for continuous availability but may interrupt the service for maintenance or for reasons beyond our control. We may improve the service, including changing the AI models used, without reducing its core function.
9. Liability
To the extent permitted by law, our liability is limited to the fees you paid in the 12 months before the event, and we are not liable for lost profits or indirect damage. This does not limit liability that cannot be excluded by law.
10. Termination and deletion
You can delete your account in the dashboard at any time. It is archived for 30 days — the widget stops and you can restore the account — and then permanently deleted together with all documents, search data and conversations. Cancel your subscription separately in the billing portal; deleting the account also stops renewal.
11. Complaints
Send complaints to [LEGAL_EMAIL] with a description of the problem. We reply within 14 days.
12. Personal data
How we handle personal data is described in the Privacy policy.
13. Data processing agreement (Art. 28 GDPR)
For the personal data of the Customer’s website visitors and of people mentioned in the Customer’s documents, the Customer is the controller and we are the processor. By accepting these terms the Customer entrusts us with that data on the following terms:
- Subject, nature and purpose: storing the Customer’s documents and generating answers to visitors’ questions in the widget, for the duration of the agreement.
- Types of data and data subjects: the content of visitors’ messages (which may include data visitors choose to type, e.g. name or phone number) and personal data contained in the documents; data subjects are the Customer’s website visitors and persons named in the documents.
- Instructions: we process the data only to provide the service as configured by the Customer, unless the law requires otherwise.
- Confidentiality and security: persons with access are bound to confidentiality; we apply the measures described in the Privacy policy (Art. 32 GDPR).
- Subprocessors: the Customer authorises the subprocessors listed in the Privacy policy (hosting, the AI model provider when a hosted model is enabled, Stripe for billing). We will announce changes in advance; the Customer may object and terminate the agreement.
- Assistance: we help the Customer respond to data subjects’ requests and meet the obligations of Art. 32–36 GDPR, and notify the Customer of a personal data breach without undue delay.
- End of processing: after the agreement ends, the data is deleted as described in section 10 (backups within 30 days).
- Audits: we provide the information needed to demonstrate compliance and allow reasonable audits announced in advance.
14. Changes to the terms and governing law
We will announce changes at least 14 days in advance by e-mail or in the dashboard; you may terminate the agreement before they take effect. Polish law applies. Disputes will be resolved by the court competent for our registered office.
